SCHWARZENEGGER’S 8 New Laws Advancing GLBT Rights For 2007

Governor’s Groundbreaking Legislation Boosts Protections for Domestic Partners
Sacramento - California’s gay,lesbian, bisexual and transgender (GLBT) community will ring in the new year with more legal protections and rights thanks to Governor Arnold Schwarzenegger. On January 1, eight new laws affecting GLBT Californians will go into effect, including a law that requires companies contracting with the state to provide employees with domestic partners the same benefits given to employees with spouses.
During the 2003-2004 legislative session, Governor Arnold Schwarzenegger signed AB 17 into law, requiring equal benefits in state contracts entered into after January 1, 2007. The legislation was modeled after a 1996 equal benefits ordinance enacted in San Francisco.
In addition to the equal benefits law, domestic partners in 2007 have the right to prepare their California income tax returns together. Couples can file jointly in 2008, covering the 2007 tax year. Other new laws that go into effect on January 1 reduce anti-GLBT bias in the courtroom, expand the state’s nondiscrimination protections, and ensure dignity and stability for GLBT seniors.
The following pieces of legislation signed into law by Governor Schwarzenegger that affect the GLBT community will be enacted on January 1: 
  

Equal Benefits in State Contracting (2003)
AB 17: Prohibits the state from contracting with businesses that do not offer equal benefits to employees with domestic partners on the same terms that benefits are offered to employees with spouses.
State Income Tax Equity Act
SB 1827: Enables registered domestic partners to file joint state income tax returns and have their earned income treated as community property.
 

Civil Rights Housing Act of 2006
AB 2800: Prohibits discrimination in housing based on race, color, religion, national origin, ancestry, disability and sex (including gender identity), marital status, sexual orientation, familial status and source of income.
Older Californians Equality and Protection Act
AB 2920: Ensures that GLBT seniors are adequately served by government services available to older Californians.
Nondiscrimination in State Programs and Activities Act
SB 1441: Prohibits discrimination based on sexual orientation and gender identity in state-operated programs.
Equality in Prevention and Services for Domestic Abuse Act
AB 2051: Creates a fund to develop and support education and services for GLBT victims of domestic violence.
Gwen Araujo Justice for Victims Act
AB 1160: Creates jury instructions and prosecutor training to limit the use of so-called “panic strategies” to influence criminal trial proceedings.
Code of Fair Campaign Practices 
AB 1207: Prohibits the use of negative appeals based on prejudice against GLBT people by candidates who sign the voluntary pledge in the Code of Fair Campaign Practices.

UNANIMOUS:California SUPREMES Decide To Hear The Marriage Cases

RosieThe California Supreme Court justices, (afffectionately known as “The Supremes“), unanimously decided to hear the appeal of the 6 same gender marraige cases today 12/20/06.  The parties opposing the ban have 30 days to file a brief on why the ban on gay marraiges should be lifted.  The opposing side will have another 30 days to respond.  Oral arguments will then be set and hopefully there will be a decision by the next holiday season (or should I dare say “Christmas”?)

The Supremes could rule in various ways: (1) They could find that only the legislature has the power to make that determination and then the bill could go to the governor (maybe Leno should hold off a year on presenting the bill to the governor?); (2) They could find that Prop 22 prohibits in state same gender marraiges and therefore any bill, including Leno’s bill would have no effect; (3) They could find that same gender couples are entitled to the benefits of marraige and therefore do a New Jersey turn and let the legislature decide if it should be called a union or marriage; or (4) They could find that the current laws are outdated and discrimiantiroy and rule in favor of full marriage rights and benefits under the California Constitution. 

Of course some people say that California same gender couples can go to a notorary and enter a domestic partnership but it is not entered into like a marriage. It is in fact a second class union.  There are no witnesses, no best man, no bridesmaids, & no official witnesses except for the notary.  There is no ceremony.  Sure, one can have a commitment ceremony but it has no legal effect.  Currently, same gender couples are legally treated different under the law.  Whether you believe it is right or not is not up to you right now but it is up to the Honorable Ronald George and THE SUPREMES to make that decision and I hope and pray they make the RIGHT decision for California.

Bush is Happy & Tony Snow Acknowledges Mary Cheney’s Child Will Be Raised By “LOVING PARENTS”

Mary CheneyWhile I am not sure how this quote is credited but as I read it (and heard it) , White House spokesman Tony Snow said Bush believes that “every human life is sacred and that every child that comes into this world deserves love and he believes that Mary Cheney’s child will in fact have loving parents.” 

The President himself is quotoed in People Magazine as saying,”I  think Mary is going to be a loving soul to her child. And I’m happy for her.”

I hope that Snow’s comment about “he believes. . .” is reflective of the President’s belief and that the president actually recognizes Mary Cheney’s partner, Heather Poe as a parent to the Vice President’s expected grandchild and that Snow does not backtrack about what Bush believes.

I want to believe that the President himself and First Lady Laura Bush recognize that Heather Poe will be a loving parent to the child.  I hope I see growth and development in the First Family’s views and definition of the meaning of  “loving parents” and I pray that this little baby will continue to change the hearts and minds of those around this precious gift and not treat this gift as a political football.

“Mary Cheney is going to make a fine mom, and she’s going to love this child a lot,” Bush said, according to an excerpt from the interview.

I know evangelical christians won’t be happy with this belief but I also know that I am.

Letter Proves Mitt Romney Sought LCR Support in 1994

Letter To LCRGov. Mitt Romney (R) has emphasized his opposition to same-sex marriage in recent months as he positions himself for an expected 2008 run for the Republican presidential nomination.  (See Washington Post.) However in 1994 Mitt wrote a letter to the Log Cabin Republicans of Massachusetts to court gay voters during his failed campaign against Edward Kennedy.  Mitt wrote: “For some voters, it might be enough to simply match my opponent’s record in this area. But I believe we can and must do better. If we are to achieve the goals we share, we must make equality for gays and lesbians a mainstream concern. My opponent cannot do this. I can and will.” A transcript of a 1994 interview with Mitt has also been released in which he stated: “I think the gay community needs more support from the Republican Party, and I would be a voice in the Republican Party to foster anti-discrimination efforts,” Romney said, according to the transcript. Tony Perkins, [not to be confused with the PSYCHO actor] president of the conservative Family Research Council, said Romney’s comments were “quite disturbing.” “This is going to create a lot of problems for Governor Romney,” Perkins told the New York Times. “He is going to have a hard time overcoming this.” Check out Andrew Sullivan’s comment on the issue

Best Wishes To The Cheney Family

 Mary CheneyMary Cheney, the daughter of Vice President Dick Cheney and wife Lynne, is pregnant, according to a published report.  

Mary Cheney, 37, and her partner of 15 years, Heather Poe, 45, are said to be  ”ecstatic” about the baby, due in late spring.

Sources have also stated that ”the vice president and Mrs. Cheney are looking forward with eager anticipation to the arrival of their sixth grandchild.”

Commenting in the Los Angeles Times of December 7, 2006, in response to various oppositions voiced to the blessed event such as by Carrie Gordon Earll, an analyst for Focus on the Family, the Colorado-based family advocacy ministry, Chris Barron, ex-political director for the Log Cabin Republicans, responded that “All of the peer-reviewed social science studies show that gay people can be and are good parents,” Barron further stated, “Research shows that the difficulty is for single parents, who are in more difficult economic situations and are forced to spend less time with the children.” Kevin

Leno Reintroduces Same Gender Marriage Bill

LenoThe AP has reported that, “Assemblyman Mark Leno, D-San Francisco, reintroduced legislation that would allow gay couples to marry in the state of California. And Sen. Carole Migden, D-San Francisco, introduced a bill that would let unmarried, heterosexual couples register as domestic partners.

Leno said he hoped the Republican Gov. Arnold Schwarzenegger, who vetoed a nearly identical gay marriage bill in 2005, would change his position on the new bill. Schwarzenegger has said it is up to voters or the courts, not lawmakers, to settle the contentious issue of gay marriage.”

California law does not permit gay marriage, but gay couples who register as domestic partners are given most of the same rights as married couples.

A Superior Court in San Francisco ruled last year that having separate rules for gay and straight couples was unconstitutional. But an appeals court reversed that decision in October, saying it was up to the Legislature, not the courts, to decide whether to change the traditional definition of marriage.

Randy Thomasson, president of the conservative Campaign for Children and Families, urged Schwarzenegger to veto both bills.”

As to the cout case, the Supreme Court has not yet decided as to whether to hear the appeal but Lockyer has joined in calling for a ruling on the ban by the California Supremes.

NOTE: It has been reported that the Supremes are expected whether to hear the appeal or not by February 14, 2007.
